The General Data Protection Regulation (GDPR), which came into force on 25 May 2018, sets out the principles to be followed when collecting, processing, and storing personal data. It also guarantees the rights of the persons concerned.
Our website uses several forms to collect data from visitors or applicants.
Objective.
The AERYS – SMARTSHAPE website collects data in order to create a management file for our company’s prospects, customers and applicants. This file is used and optimised for statistical purposes, to contact and/or offer relevant and high-quality content to interested parties. Our forms include a contact request form, a resource request form (white paper, infographics, etc.), and a registration form for events or our newsletter.
If you send us your CV or a speculative application online, we will use your personal data for recruitment purposes.
Data relevance.
In order to best monitor the interests of AERYS – SMARTSHAPE’s prospects, customers, and applicants, the file collects all information from visitors of the www.smartshape.com website relating to identity, professional information, and activity on the www.smartshape.com website. In accordance with the French Data Protection Act, information relating to a person’s race or ethnicity, their political, philosophical, or religious opinions, trade union memberships, health, and sex life is not collected and is prohibited (sensitive data).
Lawfulness of processing and conditions applicable to consent (Art. 6 and 7 of the GDPR).
Consent concerning the processing of a visitor’s personal data is systematically obtained for one or more specific purposes. For example, when submitting a newsletter registration form or downloading a white paper or infographics, the visitor’s email address will be used to send notifications concerning new publications or to offer resources that may be of interest. When submitting an application, the applicant’s postal address, telephone number, and email address will be used to contact the applicant by post, telephone, or email.
Data storage.
Data collected via the www.smartshape.com website is stored for a maximum of 12 months for anonymous contacts, following the last date on which the user was active on the website. However, for other identified contacts not pertaining to recruitment, data collected via the www.smartshape.com website is stored for a maximum period of 36 months. At the end of these periods, all data relating to the person will be automatically deleted. With regards to recruitment, and unless otherwise specified, AERYS – SMARTSHAPE may retain your personal data in its files for a certain period of time in order to contact you in the future for other employment opportunities at AERYS – SMARTSHAPE.
Individual rights.
In accordance with the French Data Protection Act and the GDPR, any and all persons may exercise their right of access, rectification, opposition, restriction of processing, deletion, and portability of data by submitting a request via signed letter, accompanied by a copy of their proof of identity, to the address of the registered office of AERYS – SMARTSHAPE. The data controller, Victor Bommelaer, will provide a response no later than one month following the request for access or rectification.
Data security and processing (Art. 32 of the GDPR).
AERYS – SMARTSHAPE undertakes to ensure the confidentiality of the data collected, and to implement all appropriate technical and organisational measures to preserve its security and integrity, in particular against accidental loss, alteration, dissemination, or unauthorised access.
In general, AERYS – SMARTSHAPE undertakes to use the data collected in strict compliance with the legislation in force, and in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, known as the GDPR.
Data collected on the www.smartshape.com website as well as through our service providers Mailchimp, Plezi, and SAP, and the associated processing, is hosted by Mailchimp, Plezi, and SAP. Only persons connected with the technical, marketing, communication, sales, and HR departments of the AERYS – SMARTSHAPE company and its service providers have access to the information collected on the www.smartshape.com website via a personal identifier unique to the Plezi platform.
Data breaches and communication within 72 hours (Art. 33 and 34 of the GDPR).
In the event of a breach or suspected breach of personal data, AERYS – SMARTSHAPE shall notify the CNIL (French National Commission on Informatics and Liberty), no later than 72 hours after becoming aware of such a breach or suspected breach.
